In this context, within the framework of this Policy, we aim to share with you the principles we adopt in carrying out the processing of personal data in compliance with the law, with particular attention to protecting fundamental rights and freedoms, especially the right to privacy.

  1. SCOPE:

This Privacy & Personal Data Protection Policy is intended to provide information about personal data collected, stored, processed, shared, and transferred by Eproc Endüstri ve Güç Sistemleri San. ve Tic. A.Ş. (weex.com.tr). All natural persons who visit the weex.com.tr website, use any weex.com.tr service, and in particular those who share data via Amazon Selling Partner APIs (SP-API) within the scope of our analysis, strategy, and management services offered to Amazon Selling Partners, are covered by this Privacy & Personal Data Protection Policy.

  1. DEFINITIONS:

"Personal data" covers all information relating to an identified or identifiable natural person (for example, name, e-mail address, date of birth, identification number). Personal data shared with us within the context of your relationship with our Company (store opening, mentorship, trademark registration application management, training, sales analysis/sales strategy development, after-sales support, etc.) is processed by our Company strictly within the purposes and scope for which it was shared.

  1. DEFINITIONS SPECIFIC TO AMAZON SP-API:

Amazon Information: Sales Data, Inventory Data, Brand Analytics Reports, Customer Order Information, and all related data provided by Amazon through the Selling Partner APIs (SP-API). This data may contain Personally Identifiable Information (PII).

Personally Identifiable Information (PII): Any information provided by an Amazon Customer, such as name, address, e-mail address, and telephone number, that can be used, directly or indirectly, to identify, contact, or locate a specific individual.

GENERAL DATA DEFINITIONS:

Personal Data: Any information relating to an identified or identifiable natural person. This includes any information showing an individual's personal, professional, and family characteristics, enabling them to be distinguished from others and revealing their attributes.

Special Categories of Personal Data: Data relating to race, ethnic origin, political opinion, philosophical belief, religion, sect or other beliefs, appearance, association, foundation or union membership, health, sexual life, criminal convictions and security measures, as well as biometric and genetic data.

Data Subject / Relevant Person: The natural person whose personal data is processed.

Data Processing Activity: Any operation performed on data such as obtaining, recording, storing, preserving, altering, reorganizing, disclosing, transferring, taking over, making available, classifying, or preventing the use of personal data, wholly or partially, by automatic means or by non-automatic means provided that it is part of a data recording system.

Explicit Consent: Consent that is freely given, specific, and informed with regard to a particular matter.

Disclosure Obligation: The obligation to inform the data subjects about who processes their personal data, for what purposes and legal grounds it may be processed, and to whom and for what purposes it may be transferred.

Anonymization: Rendering personal data unable to be associated with an identified or identifiable natural person, even when matched with other data.

Destruction: The deletion, destruction, or anonymization of personal data.

Periodic Destruction: The deletion, destruction, or anonymization processes carried out ex officio at specified intervals when all conditions for processing personal data cease to exist.

Recording Medium: Any medium in which personal data is stored, processed wholly or partially by automatic means or by non-automatic means provided that it is part of a data recording system.

  1. WHICH PERSONAL DATA IS COLLECTED?

When you visit our website or use our services, we collect various personal data about you.

When you enter our website, register on weex.com.tr and create a membership, or purchase a service, we collect the information necessary to provide the services you request effectively and securely. This information may include:

  • Your personal information (e.g., name, address, mobile phone number, e-mail address, tax/ID number).
  • Accounting and Finance Data: (e.g., credit card number, card expiration date, installment preference, tax identification number).
  • Customer Transaction Data / Transaction Security Data: If you wish to become a customer of weex.com.tr services, information identifying the type and identity of your business/enterprise, contact information, introductory and descriptive information and documents related to your business, and records relating to your use of weex.com.tr products and services (IP address, web infrastructure used, etc.) will be obtained.
  • Amazon Information and PII:
    • Amazon Information obtained via SP-APIs that forms the core of our services (Sales Reports, Performance Data, Brand Analytics Reports, Inventory Information).
    • Seller PII (Name, E-mail address) required to authorize and manage your Amazon Seller account.
    • Un-anonymized Personally Identifiable Information (PII) of Amazon Customers, processed only where mandatory for the core service function of our application (e.g., shipment or return management) and in compliance with Amazon policies.
  • External Commercial Data (Pursuant to AUP 4.3):
    • Commercial data obtained from sources other than Amazon MWS and integrated with your explicit consent to extend the scope of the analysis and reporting services in our application (e.g., shipping records of logistics providers, expense data from external accounting systems).
  • If you are a seller on a platform (e.g., a marketplace), identifying information about your business, contact details, and bank account information will be transferred to the marketplace of which you are a member.
  • Website Membership Records: (e.g., username and password)
  • Your Consent Records for Commercial Electronic Messages will be retained as required by law.
  • Audio Data: If you contact our call center, audio data relating to the telephone conversation will be retained in our company records to ensure transaction security.
  • Website Cookies: Information obtained through cookies, beacons, and other tracking mechanisms that are necessary for the functional operation of the website (e.g., details of your device, geographic location, and usage). Consent to cookies we use to provide services and for marketing activities aligned with your interests is subject to your choice as a user.
  • Additional information provided to us when you use optional services offered by weex.com.tr or contact Weex.com.tr is also collected.
  1. PURPOSES OF PROCESSING PERSONAL DATA AND LEGAL BASES

We use personal data you share with us for various purposes permitted by applicable legal regulations. Our purposes for using your personal data are explained below with examples. Your personal data is processed by us based on the following legal bases:

  1. Personal data may be processed with the data subject's explicit consent.
  2. Personal data may also be processed without the data subject's explicit consent if one of the following conditions exists:
  • It is expressly provided for by law;
  • It is necessary to protect the life or physical integrity of the data subject or another person where the person concerned is unable to give consent due to actual impossibility or whose consent is not legally valid;
  • It is necessary to process personal data of the parties to a contract, provided that it is directly related to the establishment or performance of such a contract (this includes the use of data provided through the Amazon SP-API to fulfill the service agreement signed with us);
  • It is mandatory for our Company to fulfill its legal obligations;
  • The data has been made public by the data subject;
  • Data processing is necessary for the establishment, exercise, or protection of a right;
  • Data processing is necessary for the legitimate interests of our Company, provided that it does not harm the fundamental rights and freedoms of the data subject.

In this context, your personal data is processed for the following purposes, limited to:

  • Providing products and services to customers and enabling online payment transactions via the website:

We need to use your personal information to deliver our products and services to you, to provide the payment infrastructure, to store your credit cards for future use at your request, and to allow you to create, access, and make changes to a membership account.

  • Providing Amazon Selling Partner (SP) Services and Analytics (AUP 4.1 PII Justification):

This data, including Amazon Information and Personally Identifiable Information (PII), is processed solely to perform the core functions of the application. The necessity for PII and its basis are as follows:

  • PII (Seller): Processing of Personally Identifiable Information such as Name and E-mail to authorize your Amazon Seller account (OAuth), manage secure access to your application, and communicate with the authorized person is **necessary for the performance of the contract**.
  • PII (Customer): Processing of Amazon Customer PII data (Address, Name) to provide Selling Partners' logistics and operational services such as shipping, returns, and customer relationship management is **necessary for the application to perform its core function** and is **strictly limited to this purpose**.
  • Amazon Information: Used to provide analytical services such as Selling Partner Analytics, Reporting, Pricing, Inventory Management, and general commercial strategy development.
  • Improving our services and managing our operational requirements:

We monitor the use of our websites and services and analyze usage data to improve our performance. Amazon Information collected for this purpose may be anonymized so that it does not contain identifying information.

  • Contacting you when necessary:

We use your contact information to inform you about the status of the transactions you conduct. We may also use your contact information to reach out and resolve any issues that arise regarding your transactions or account. Those contacting you on behalf of our Company may be our employees directly, or our business partners from whom we receive services; in which case, your personal data may need to be shared with these business partners.

  • Fulfilling our legal obligations or resolving disputes:

Some regulations where we operate may require us to use and retain your information in certain ways. In the event of a legal dispute, this information may be shared with the relevant legal authorities. Data may also be processed to fulfill data protection obligations, including Amazon SP-API policies.

We may also use your information for other purposes to which you have consented. For example, we may obtain your consent for other processing activities such as sending you marketing communications, receiving feedback from you, or transferring data to allow you to benefit from services offered by our solution partners. In such cases, you may withdraw your consent at any time by contacting us using the contact information at the end of this document. We may request documents and information identifying you in order to effectively conclude your request.

  1. USE OF COOKIES AND OTHER INTERNET TECHNOLOGIES

When using the Weex.com.tr website and services, access data such as your internet service provider's name, IP addresses, and pages browsed is collected. This information is used to provide website infrastructure and conduct statistical analysis. In addition, cookies and beacons belonging to weex.com.tr or other service providers (e.g., Google Analytics, etc.) are used to collect information about your usage and use this information to provide site functions, manage site infrastructure, and for marketing purposes.

You can refuse the use of optional cookies by selecting the appropriate settings in your browser, but please note that if you do so, you may not be able to fully use this website. By using our website or benefiting from our services, you consent to the processing of your personal data by Google, infrastructure providers supporting our services (e.g., Amazon Web Services), and other third-party service providers as explained above.

  1. STORAGE AND DESTRUCTION OF PERSONAL DATA

Your personal data may be stored for periods determined in accordance with the purposes of storage in line with industry practices, whether the legitimate interest in storage continues, legal risks, costs and responsibilities, and the principle of being accurate and up-to-date when necessary. After the storage period, your personal data will be deleted, destroyed, and/or anonymized ex officio or upon your request by our Company using methods within the scope of laws and relevant regulations.

Special Retention Rules for Amazon Information (Pursuant to RDA 2.1):

  • Amazon Customer Personally Identifiable Information (PII): Amazon Customer PII data processed by our application (e.g., Shipping Address, Customer Name) will be securely deleted, destroyed, or anonymized within no later than thirty (30) days after the service performance ends or commercial purpose ceases. Only PII data whose retention is required by applicable law is exempt from this period.
  • Amazon Information (Non-PII data): Amazon Information other than PII collected to ensure the continuity of services such as Sales, Inventory, and Brand Analytics may be retained for a maximum of ten (10) years after the legal relationship ends.

When you close your account or request the deletion of your personal data, we delete or anonymize such data except for data we are legally required to keep even when you close your account, or data for which we have rejected your deletion request.

The cookies we use have specific validity periods, and if you do not use our website or services during this period, they will automatically be disabled and the stored data will be deleted.   1. TRANSFER OF PERSONAL DATA TO THIRD PARTIES

For example, when we receive your payment information, we transmit it to relevant financial institutions (e.g., Iyzico, Payoneer, Wise, banks) to process your payment.   • Transfer of Amazon Information (Pursuant to AUP 4.6):
    • Service Providers: The main third parties with whom we share Amazon Information (including PII) are cloud computing service providers (AWS, Azure, etc.), error tracking, and logging service providers. This sharing is limited solely to the technical functions necessary to provide the core service of the application.
    • Sharing Restriction: Sharing, selling, or renting Amazon Information and PII data to third parties for marketing, advertising, recommendation, or other commercial purposes is strictly prohibited. All parties to whom transfers are made must fully comply with Amazon's Data Protection Policies.

Law enforcement and other authorized agencies may request your personal data from us. We share this information only when we are legally required to do so or when we believe it is necessary to prevent or investigate a crime.

We may need to share your data with third parties for other operational purposes as well. These operational purposes cover various activities such as company audits, corporate governance, and exercising our legal rights. We always act in accordance with legal regulations when making these disclosures.


  1. INTERNATIONAL TRANSFER OF PERSONAL DATA

Due to the nature of the services we offer, we may need to transfer some personal data internationally. Most of our information technology infrastructure is located in Turkey, and therefore, if you access our website or use our services from a country outside Turkey, your personal data will be transferred to Turkey.

Data transfers to the third parties described above may require your personal data to be transferred to different countries. However, in any case, we guarantee that your personal data will only be transferred to countries that provide adequate protection or to persons outside these countries who undertake to ensure the security of your data in accordance with regulations. As explained in Section 4, we also use cookies to better provide our services. You can use your browser settings to reject these cookies, but if you reject these cookies, you may not be able to use our website and services.

From time to time, we contact you. This communication may be marketing-related or related to transactions to which you are a party. You may refuse to receive all marketing-related communications by following the instructions at the bottom of the messages sent to you. However, we are required to send you notifications regarding transaction security.


  1. YOUR RIGHTS REGARDING YOUR PERSONAL DATA:

We would like to inform you that you have the following rights in accordance with legal regulations:

(a) To learn whether your personal data is being processed, the processed personal data, the sources from which the personal data is obtained, the third parties to which it has been transferred domestically and abroad, the period of retention or the criteria used to determine such period;

(b) To access your personal data and request that the personal data you have provided be given to you in a structured, commonly used, and machine-readable format or transferred to another data controller;

(c) To learn the purpose of processing your personal data and whether it is used in accordance with its purpose;

(d) To object to or request the restriction of the processing of your personal data;

(e) To request the correction of your personal data if it has been processed incompletely or incorrectly;

(f) To request the deletion or destruction of your personal data when the reasons requiring its processing no longer exist. (The right to have Amazon PII data deleted within 30 days after the service performance ends is specifically emphasized in this context.)

(g) To request that operations such as correction and deletion be notified to third parties to whom your personal data has been transferred;

(h) To object to a result that arises against you through the analysis of the processed data exclusively through automated systems;

(i) To request compensation for damages in the event of harm due to unlawful processing of personal data.

You may exercise your rights regarding your personal data listed above by contacting us using the contact information at the end of this document. When making this application, in order for us to recognize you, you must provide the information you provided when registering or using our services in full and attach a copy of an official identification document.


  1. PROTECTION OF PERSONAL DATA (AMAZON RDA COMPLIANCE)

All personal data obtained by us is transmitted and stored under reasonable security conditions accepted in the industry. Our website has an SSL (Secure Sockets Layer) certificate. The connections through which personal data is transferred are encrypted and protected. Although we take all reasonable measures to protect your personal information, it is your responsibility to secure your password and account information.

Additional Security Procedures Meeting Amazon's Data Protection Requirements (RDA):

  • Vulnerability Management: Regular vulnerability scans and penetration tests are carried out on our application and infrastructure, and a formal process is followed for prioritization and timely remediation tracking of identified findings.
  • Credential Management: For credentials used by our employees and systems, strong password policies are mandatory, including a minimum of 12 characters, complexity (uppercase/lowercase letters, numbers, special characters), and periodic expiration/rotation.
  • Logging and Monitoring: Centralized logging and monitoring systems are used throughout our application and server infrastructure to monitor, detect, and record all API calls and sensitive data access and any malicious activity.
  • Risk Management and Incident Response Plan (IRP): In the event of a data breach, unauthorized access, or data leak, our Company implements an Incident Response Plan that includes steps for detection, containment, root cause analysis, and includes the obligation to notify Amazon within 72 hours.

  1. LEGAL NOTICE

Our services and website are not intended for use by children (any person who is not legally an adult). We do not collect personal data from children or persons who cannot legally use our services. When we become aware that we have obtained personal data of a child, we delete it immediately unless we are legally required to retain it. If you believe we have obtained personal data of a child due to error or oversight, please contact us immediately using the contact information below.

We may make changes to this privacy policy. Changes made shall take effect from the date on which the new privacy policy is published.

Users and our customers are obligated to follow any updates.

  1. PARTIES

This Agreement is made between the person whose user information is registered on the website www.weex.com.tr and/or who has purchased a product/service (hereinafter referred to as the User) and Eproc Endüstri ve Güç Sistemleri San. ve Tic. A.Ş. (hereinafter referred to as Weex). When the User registers on the website www.weex.com.tr, they are deemed to have accepted the terms and conditions of this Agreement.

Weex and the User shall be referred to individually as a "Party" and collectively as the "Parties". The Parties have agreed to the following terms.

  1. DEFINITIONS

Site:

Refers to the website consisting of the domain name www.weex.com.tr and its subdomains, on which Weex offers the products and services defined in this agreement, as well as Weex's iOS and Android applications.

Products/Services:

Refers to all e-commerce-oriented products and services provided by Weex on the Site for the User to carry out the operations defined in this agreement. These services include processing, analyzing, and reporting Amazon Information obtained via Amazon Selling Partner APIs (SP-API) with the User's authorization.

Member:

Refers to natural or legal persons who wish to benefit from the purchase of products/services from the Site, fill out the membership form completely, and have their membership applications approved by Weex.

User:

Refers to the natural or legal person who benefits commercially from the website with the domain www.weex.com.tr or via the iOS and Android applications, or purchases products and/or services, within the conditions set out in the warnings, writings, and explanations published by Weex on the Site regarding use, membership, and products and services.

Buyer:

A User who purchases goods and/or services offered for sale by the Seller by using the Services offered on the Site.

Seller / Service Provider:

A User who, by using the Services offered on the Site, offers for sale to other Users goods and/or services that they legally own and have the right and authority to dispose of.

Amazon Information:

Refers to all data accessed or derived via the Amazon Selling Partner APIs (SP-API). This data includes Order Information, Inventory data, Sales and Performance metrics, and Personally Identifiable Information (PII) of Amazon Customers.

  1. SUBJECT OF THE AGREEMENT

The subject of this agreement is to determine the terms and conditions for the User to benefit from the Products/Services offered by Weex on the Site, and to determine the rights and obligations of the parties in this respect. In this context, the User's commitments regarding the secure and limited processing of Amazon Information through the application are also regulated.

  1. WEEX'S RIGHTS AND OBLIGATIONS
  • Weex is the sole rights holder of all content (products/services) on the Site. Without Weex's prior written consent, copying, processing, using, or publicly disseminating all or part of the content on the Website or mobile application by a member or User for any purpose is strictly prohibited. In the event this is detected, Weex reserves the right to unilaterally terminate the agreement (with all rights regarding damages arising from termination reserved) and to retain fees paid by the User without refund.
  • Weex may share all information and documents it has about the User with the relevant authorities in the event of a request for documents or information from official administrations, judicial bodies, or authorized authorities. Additionally, it may share the necessary data in line with audits and information requests made under Amazon's Data Protection Standards (RDA).
  • Weex will store the personal and commercial information obtained from the Member or User during registration and throughout the membership in a secure environment in line with the Privacy Policy announced on the Site and the principles set out therein. Weex may use this information for the purposes of implementing the applications necessary for the proper operation of the Services, conducting statistical evaluations, advertising and marketing Weex's activities and applications, announcements, and other purposes. Except for legal obligations, Weex may disclose this information to third parties only for the reasons mentioned above. Amazon Information obtained in this context will be processed and stored within the purposes and limitations specified in the Privacy Policy. The Member or User accepts and declares that they consent to the use and storage of their information by Weex in accordance with this article.
  • Weex has the right to take all necessary measures and make changes for the proper and adequate operation and security of the Site. For this purpose, Weex may change the services and content offered at any time without prior notice.
  • Weex shall at all times have the right to temporarily suspend or cancel the Services offered on the Site by terminating this Agreement. Such situations will be notified to the User by Weex via e-mail. The User's registered e-mail address on the Weex Site will be used as the e-mail address. Weex reserves the right to immediately and unilaterally suspend or terminate the membership if the User violates Amazon's Acceptable Use Policy (AUP).
  • Weex may change the services, durations, additional features, and technical specifications offered on the Site without prior notice. Changes shall be effective from the date of publication.
  • Weex is responsible for storing information about the package purchased by the User in its database and sharing this information with the User when deemed necessary.
  • Weex's Site has an SSL certificate and has taken the necessary measures for site security. Compliance with all physical, technical, and administrative security measures specified in Amazon's Data Protection Standards (RDA) is committed. Nevertheless, the User acknowledges that damage may occur due to viruses, hacking, or other security breaches during the use of services, and in the event such damage occurs, Weex shall not be responsible for such damages.
  • Weex may transfer this agreement and/or its rights and obligations arising from the agreement to third parties, wholly or partially, to the extent permitted by the provisions of applicable legislation. The User shall not transfer the rights and obligations arising from this agreement without Weex's written permission.
  1. USER'S RIGHTS AND OBLIGATIONS:
  • In order for the User to acquire "User" status, they must first completely fill in the information requested by Weex on www.weex.com.tr regarding new membership information. When they complete the membership application by accepting the terms of this agreement and confirm the verification e-mail sent by Weex to the e-mail address entered into the system, their membership is defined and they acquire "Member" status. A natural or legal person who has acquired "Member" status then acquires "User" status by purchasing products/services on the "Site". Where necessary for the performance of the service, the User agrees and undertakes to grant Weex authorization to access their Amazon Selling Partner account (SP-API). This authorization shall be limited to the services offered by Weex. Weex reserves the right to reject the User's application at any time without giving reasons and/or to request additional information or documents. The User shall be solely responsible for all damages that may arise due to false information being provided during the application.
  • The Member/User creates an account with a username and password determined by themselves to register on the Site and purchase products/services. The confidentiality and security of the information belonging to this account is the responsibility of the Member/User. The Member/User accepts, declares, and undertakes that the responsibility for transactions occurring or likely to occur from their account belongs to themselves. The Member/User cannot raise any objection or dispute claiming that transactions performed in this way were not carried out by them, and cannot avoid fulfilling their obligations based on such objection. The Member/User accepts, declares, and undertakes that they will compensate for damages arising or likely to arise from such transactions.
  • The Member or User accepts, declares, and undertakes that they will not engage in conduct amounting to unlawful acts against Weex or the Site, and will not engage in unfair competition. In particular, they accept and undertake that they will not copy Amazon Information (including PII) from Weex in an unauthorized manner, will not use it for other purposes, and will not process it for marketing or advertising activities. In the event this is detected, Weex reserves the right to unilaterally terminate the agreement and to claim compensation for damages occurring or likely to occur.
  • The User accepts, declares, and undertakes that they will not engage in activities that would violate the copyrights or other intellectual property rights on the Services, or disclose Weex's commercial secrets or confidential information, and that they will be responsible for compensating any damages arising otherwise.
  • The Member/User is obligated to notify Weex, within one week at the latest from the occurrence of any change in the information provided during the membership application, through the support/contact or e-mail methods on the Weex Site. In the event that Weex suffers any damages due to the failure to make such notification, Weex reserves the right to claim compensation from the User for any damages that may arise.
  • The User may use the purchased Service only for their own use and may not transfer it to others. The User undertakes not to offer the Service they have received to any person or institution other than themselves.
  • The User shall be able to benefit from the Services on the condition that they fully and duly fulfill their obligations specified in this Agreement. The fee the User will pay to Weex to benefit from these services shall be determined by the package price list on the Site. The prices on the date the User purchases the package are valid until the end of the foreseen duration, limited to the products/services specified in the package. Weex has the right to change package prices at any time. In the event of such a price change, the User may continue to use the package previously purchased until the end of the package period without any additional payment. A User who wishes to renew membership or purchase a new package at the end of the package period shall pay the fee in the current package price list on that date.
  • In the event that a Member/User's membership is suspended by Weex for any reason or they are removed from membership and blacklisted so that they are never again admitted to Weex platforms, the Member/User cannot become a member of the Site with another user account. In the event that the Member/User becomes a member of the Site in violation of this article and this is detected, the User will be removed from membership again and will be responsible for compensating any possible damages.
  • Changes made by Weex on the Site and changes related to service fees shall become effective and binding on the date of publication. The User is obligated to follow these changes from the Site and comply with the requirements of the changes.
  • If the performance of the Service becomes impossible after the sale of Products and Services offered for a fee but before their use begins, the User shall have the optional right to request the replacement of the Service package with a new usable Service package or a refund of the fees paid. However, if the User does not exercise the right to replace within one month from the date this matter becomes known, they may only request a refund of the fee paid.
  1. SERVICE FEES

The packages and fees of Products and Services offered by Weex are published on the Site. Weex may change service fees and service content at any time provided that they are published on the Site. If the Parties agree on obtaining a Product and Service other than those offered on the Site, they may agree on a different service fee based on the nature of the work. Weex may also receive sales commissions from the services of partner companies at the rates specified in the Partnership section, and may update these rates at any time. A user who continues to sell on the date the commission rate is updated is deemed to have accepted the new commission rates.

  1. PAYMENT PLAN

The fees for Service packages published on the Site shall be paid in advance.

The monetary points accumulated in the wallet from services bought and sold through the Site, which can only be used as discounts for in-site spending, and the sales commissions of partners can be used as earnings 32 days after the sale date.

  1. FORCE MAJEURE
  • The parties cannot be held responsible for disruptions arising from unforeseen circumstances (Force majeure/situations) that do not arise from the fault or negligence of either party or that occur beyond the control of the affected party, and for the failure to fulfill contractual obligations as a result of such Force majeure.
  • The Party affected by force majeure shall notify the other Party in writing/by e-mail within two weeks.
  • Unless otherwise instructed by the other party, the party affected by force majeure shall continue its work in accordance with the contract conditions as far as possible, and in the meantime, shall seek alternative ways to fully and properly fulfill its obligations without being affected by force majeure.
  • If the force majeure situation continues for more than 30 (thirty) days after notification to the other party, each party shall have the right to terminate the agreement immediately by notifying the other party in writing/by e-mail without any obligation to compensate the other party.
  1. TERMINATION
  • The Parties may unilaterally terminate this agreement. In the event the User unilaterally terminates the agreement before the end of the agreement period, Weex shall not refund any money. The User accepts this in advance.
  • Weex may immediately and unilaterally terminate the agreement and the membership on the Site in the event that the User violates this Agreement or Amazon's Data Usage Policy (AUP). In this case, the User accepts, declares, and undertakes in advance that they are responsible for all damages and losses that Weex has suffered/may suffer.
  • Termination and Data Destruction (Amazon PII): In the event of termination of the agreement for any reason, Weex undertakes to securely delete or anonymize the Personally Identifiable Information (PII) of Amazon Customers accessed through the User's Amazon seller account and other sensitive data within thirty (30) days from the termination date at the latest, except for legal obligations.
  1. RESOLUTION OF DISPUTES

In disputes that may arise in the application of this agreement, the Gebze and Istanbul Anadolu Courts and Enforcement Offices are authorized.

  1. NOTIFICATIONS and EVIDENCE AGREEMENT

Within the framework of this Agreement, all correspondence between the Parties, except for mandatory cases provided for in the legislation, shall be made via e-mail. The User accepts, declares, and undertakes that in disputes that may arise from this Agreement, Weex's official books and commercial records, as well as electronic information and computer records kept in its own database and servers, shall constitute binding, conclusive, and exclusive evidence, and that this article constitutes an evidence agreement within the meaning of Article 193 of the Code of Civil Procedure.

  1. ENTRY INTO FORCE DATE OF THE AGREEMENT

This agreement is deemed signed and accepted by the User on the date the order is confirmed in the system and enters into force.

Your personal data will be stored for the purposes listed above as long as your website/application membership continues. Retention during this period is carried out only for legally permitted purposes such as fulfilling legal obligations or dispute resolution and under strict security measures.

After the period expires, your personal data will be deleted, destroyed, and/or anonymized by our Company ex officio or upon your request using the methods within the scope of the Personal Data Protection Law and relevant regulations.
